As a DUI defense attorney, I will examine whether proper protocol was followed during every step of the stop and vigorously attack holes in the prosecutor’s case.

DOMESTIC VIOLENCE

Domestic violence (DV) cases are more aggressively prosecuted today than ever before because of heavy pressure the police and prosecutors are receiving from special interest groups devoted to stopping domestic violence. Domestic violence, depending on the severity of the harm caused and whether you have previous domestic violence charges, can result in charges ranging from a misdemeanor of the fourth degree all the way to a third degree felony.

DRUGS

The first line of defense in any drug case is to evaluate whether or not the police conducted an illegal search of your home, automobile or your person. Under the Fourth Amendment to the U.S. Constitution, you have a right to be protected against illegal searches and seizures by police investigators. I understand the law of illegal searches and seizures and am available to evaluate the circumstances of your case today.

PROBATION VIOLATIONS

Probation violations are one of the most common forms of criminal prosecution. A probation violation is initiated by a probation officer when a Defendant violates the terms and conditions set in place by the Court when a Defendant has been previously convicted of an offense. Sometimes a probation violation can arise merely due to a miscommunication between the Defendant and probation officer. Under such circumstances, it could be necessary to hire an attorney to clear up the miscommunication so that the Defendant can continue on probation. Even if the violation is not the result of a miscommunication, an experienced attorney may be able to prevent jail or prison time that could result from the violation.

THEFT, FRAUD, and FORGERY

Theft or property crimes can be serious, depending upon the value of the property stolen and/or the criminal record of the defendant. Any theft of property in excess of $1000 will result in a felony indictment. As the value of the property increases, the level of the felony increases as well. Just being in possession of stolen property can result in a felony indictment if the value of the property exceeds $1000 with the level of the offense increasing along with the value of the property.

Fraud is the act of knowingly obtaining, by deception, some benefit for oneself or another, or to knowingly cause, by deception, some detriment to another. Fraud comes in a variety of forms such as telecommunications fraud, Medicaid fraud, food stamp fraud, insurance fraud, identity fraud, defrauding of creditors, and workers compensation fraud.
Forgery is a subsection of Fraud but will always result in a felony indictment as the State has an interest in preventing the most common type of forgery, check fraud.

As when dealing with a drug offense or DUI, it is necessary to determine whether police followed proper protocol in their investigation, particularly during the interview process of the alleged perpetrator. Remember, you always have the right to remain silent during an interrogation; however, you must affirmatively exercise that right by stating that you wish to remain silent and speak with an attorney.

VIOLENT CRIMES

Violent crimes can result in very serious convictions and punishment, and require an aggressive defense by an experienced defense lawyer. The most common violent crimes are assault, assault with a deadly weapon (felonious assault), robbery, kidnapping and sexually oriented violent crimes such as rape.
